Terms of Service

These Terms of Service ("Terms") govern your access to and use of the KIKOBA Smart mobile app, web portal, and related services ("Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

KIKOBA Smart is a software platform that helps savings and lending groups (vikoba) record members, savings, loans, repayments, meetings, and communications. We provide the software; we are not a bank, lender, or party to the financial arrangements between you and your group. Your group is responsible for its own savings, lending, and repayment decisions.

3. Payments, subscriptions & fees

Some features require a subscription or member fee. Prices are shown before you pay. Payments are processed through third-party mobile-money providers. Fees are generally non-refundable except where required by law. You authorise us to charge the applicable fees for the plan or fee you select.

4. Acceptable use

You agree not to: misuse or disrupt the Service; access data you are not authorised to access; upload unlawful content; attempt to reverse engineer or compromise the Service; or use it for fraud or any illegal activity.

5. Your content & data

You and your group retain ownership of the records you enter. You grant us a limited licence to host and process that data to provide the Service, as described in our Privacy Policy.

6. Service availability

We work to keep the Service available and reliable, but we provide it "as is" and do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue features with reasonable notice where practical.

7. Limitation of liability

To the maximum extent permitted by law, KIKOBA Smart is not liable for indirect, incidental, or consequential losses, or for loss of profits, savings, or data arising from your use of the Service. We are not responsible for the financial decisions, defaults, or disputes within your group.

8. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms or the law.

9. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes means you accept the updated Terms.

Masharti ya Huduma

Masharti haya ya Huduma ("Masharti") yanasimamia ufikiaji na matumizi yako ya programu ya simu ya KIKOBA Smart, tovuti ya portal, na huduma zinazohusiana ("Huduma"). Kwa kutengeneza akaunti au kutumia Huduma, unakubali Masharti haya na Sera yetu ya Faragha. Kama hukubali, usitumie Huduma.

1. Huduma

KIKOBA Smart ni jukwaa la programu linalosaidia vikundi vya akiba na mikopo (vikoba) kuweka kumbukumbu za wanachama, akiba, mikopo, marejesho, mikutano, na mawasiliano. Sisi tunatoa programu; sisi si benki, mkopeshaji, wala mhusika kwenye mipango ya kifedha kati yako na kikundi chako. Kikundi chako kinawajibika kwa maamuzi yake ya akiba, ukopeshaji, na marejesho.

3. Malipo, usajili na ada

Baadhi ya huduma zinahitaji usajili au ada ya mwanachama. Bei huonyeshwa kabla ya kulipa. Malipo huchakatwa kupitia watoa huduma wa pesa za mtandao. Ada kwa ujumla hazirejeshwi isipokuwa pale sheria inapotaka. Unaidhinisha kutozwa ada husika kwa mpango au ada uliyochagua.

4. Matumizi yanayokubalika

Unakubali kutofanya: kutumia vibaya au kuharibu Huduma; kufikia taarifa usizoidhinishwa; kupakia maudhui haramu; kujaribu kubadilisha au kuhujumu Huduma; au kuitumia kwa udanganyifu au shughuli yoyote haramu.

5. Maudhui na taarifa zako

Wewe na kikundi chako mnabaki na umiliki wa kumbukumbu mnazoweka. Unatupatia leseni ndogo ya kuhifadhi na kuchakata taarifa hizo ili kutoa Huduma, kama ilivyoelezwa kwenye Sera ya Faragha.

6. Upatikanaji wa Huduma

Tunafanya kazi kuhakikisha Huduma inapatikana na ni ya kuaminika, lakini tunaitoa "kama ilivyo" na hatuhakikishi haitakatizwa au kutokuwa na makosa. Tunaweza kubadilisha, kusitisha, au kukomesha huduma kwa taarifa ya kuridhisha pale inapowezekana.

7. Ukomo wa dhima

Kwa kiwango kinachoruhusiwa na sheria, KIKOBA Smart haiwajibiki kwa hasara zisizo za moja kwa moja, za bahati mbaya, au za matokeo, wala kupoteza faida, akiba, au taarifa kutokana na matumizi yako ya Huduma. Hatuwajibiki kwa maamuzi ya kifedha, kushindwa kulipa, au migogoro ndani ya kikundi chako.

8. Kusitisha

Unaweza kuacha kutumia Huduma na kuomba kufutwa kwa akaunti wakati wowote. Tunaweza kusimamisha au kufuta akaunti zinazokiuka Masharti haya au sheria.

9. Mabadiliko ya Masharti haya

Tunaweza kusasisha Masharti haya mara kwa mara. Tutaweka toleo lililosasishwa hapa na kubadilisha tarehe ya "Imesasishwa". Kuendelea kutumia baada ya mabadiliko kunamaanisha umekubali Masharti yaliyosasishwa.
